AI Data & Usage Policy

This AI Data & Usage Policy ("Policy") governs your use of the AI-powered tools and assistants ("AI Assistant") embedded within courses and learning experiences offered through Assisting Intelligence (assistingintelligence.com), a brand and service of SmarterMedium, LLC, a limited liability company organized in Massachusetts, USA ("Company," "we," "our," or "us").

This Policy is a standalone agreement that supplements our Terms of Service and Privacy Policy. In the event of a conflict between this Policy and the Terms of Service, the more restrictive provision applies. By accessing or using the AI Assistant, you ("User," "Learner," "you," or "your") agree to be bound by this Policy.

2.1 Intellectual Property

The AI Assistant is a derivative work engineered by SmarterMedium, LLC using proprietary Intellectual Property. While the underlying AI models may be provided by third-party technology providers, the following elements are the exclusive Intellectual Property of SmarterMedium, LLC:

System Prompts and Prompt Architecture

Contextual Data and Coaching Frameworks

Fine-Tuning Datasets and Instructional Logic

Logical Workflows and Interaction Design

2.2 No Reverse Engineering

You agree not to attempt to reverse-engineer, "jailbreak," or use prompt injection techniques to reveal, extract, or reconstruct the underlying system instructions, training data, or proprietary logic of the AI Assistant. Any such attempt constitutes a material breach of this Policy and may result in immediate suspension or termination of access.

3.1 Technology Changes

The AI models, providers, and infrastructure powering the AI Assistant may change at our sole discretion. We do not guarantee continuity of any specific AI provider, model version, or capability. We will endeavor to maintain or improve the quality of the AI Assistant experience, but specific behaviors, response styles, or capabilities may vary as underlying technologies evolve.

3.2 No Guarantee of Availability

The AI Assistant is provided on an "as available" basis. We do not guarantee uninterrupted, error-free, or continuous access. The service may be temporarily unavailable due to scheduled maintenance, third-party provider outages, capacity limits, or circumstances beyond our control. We will make reasonable efforts to minimize disruption but assume no liability for periods of unavailability.

3.3 No Guarantee of Accuracy

The AI Assistant may produce responses that are inaccurate, incomplete, outdated, or inappropriate for your specific situation. All AI-generated outputs should be treated as a starting point for your own professional judgment — not as professional, legal, financial, medical, or regulatory advice. You are solely responsible for evaluating and validating any output before acting on it.

4.1 Human-Scale Usage

To ensure quality and responsiveness for all learners, "Unlimited" access to the AI Assistant is defined as "Human-Scale Usage" — usage consistent with a typical individual learner's coursework and professional development workflow.

4.2 Prohibited Activity

The following activities are strictly prohibited:

Use of automated scripts, bots, spiders, scrapers, or any programmatic or bulk access to the AI Assistant

Sharing account credentials to allow multiple individuals to use a single license

Using the AI Assistant for purposes unrelated to the licensed course or learning experience

Reselling, sublicensing, or commercially redistributing AI Assistant access or outputs

4.3 Usage Monitoring & Enforcement

We monitor aggregate usage patterns to protect system stability and ensure equitable access. If a user's consumption exceeds 3x the average usage of the cohort (approximately 3,000 queries per month) or adversely impacts system performance for other users, we reserve the right to:

Throttle response speeds

Temporarily cap queries

Suspend the account pending a usage review

We will notify you before or promptly after taking any such action and work with you to find a reasonable path forward.

Current pricing reflects third-party AI infrastructure costs at the time of your enrollment. Because underlying AI provider pricing, token costs, and compute expenses may change materially, we reserve the right to:

Introduce usage-based surcharges for consumption that exceeds fair usage thresholds

Adjust plan pricing for future enrollment periods

Modify fair usage thresholds as usage patterns and costs evolve

Any pricing changes affecting current enrollees will be communicated with a minimum of 30 days' written notice to your registered email address. You may cancel your enrollment before changes take effect.

6.1 Your Outputs

You retain 100% ownership of the specific business strategies, documents, action plans, and other original outputs you co-create with the AI Assistant during your sessions.

6.2 Our Methodology

SmarterMedium, LLC retains exclusive ownership of the methodology, coaching frameworks, prompt architecture, and instructional logic used to generate those outputs. Your right to use AI-generated outputs does not transfer any rights to the underlying system that produced them.

7.1 Conversation Data

Your interactions with the AI Assistant are processed through third-party AI infrastructure. We do not use your conversation data to train, fine-tune, or improve AI models. Conversation data is retained only as necessary for service operation, quality assurance, and abuse prevention.

7.2 Session Data Non-Persistence

Conversations with the AI Assistant may not be saved between sessions. You are responsible for copying, exporting, or otherwise capturing any outputs you wish to retain before ending a session. We are not responsible for the loss of unsaved session data.

7.3 Cross-Reference

All data collection, storage, and processing practices are governed by our Privacy Policy. This Section 7 addresses data handling specific to the AI Assistant and does not replace or limit the Privacy Policy.

You agree not to input into the AI Assistant:

Confidential or proprietary information belonging to third parties without proper authorization

Personally identifiable information (PII) of others, including employees, clients, or customers

Protected health information (PHI) or financial account data

Content that is illegal, defamatory, threatening, harassing, or that violates the rights of any third party

Content intended to generate outputs for illegal, fraudulent, or harmful purposes

You are solely responsible for the content you submit and the use you make of any outputs. SmarterMedium, LLC is not liable for any consequences arising from your inputs or your use of AI-generated outputs.

Use of the AI Assistant requires that you be at least 18 years of age. If you are accessing the AI Assistant through an enterprise or organizational license, the enrolling organization is responsible for ensuring all authorized users meet this age requirement and comply with this Policy.

THE AI ASSISTANT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE AI ASSISTANT WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, OR PRODUCE ACCURATE OR RELIABLE RESULTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SMARTERMEDIUM, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING OUT OF OR RELATED TO YOUR USE OF THE AI ASSISTANT, REGARDLESS OF THE THEORY OF LIABILITY.

We may update this Policy from time to time. Changes will be communicated with a minimum of 30 days' written notice to your registered email address. Continued use of the AI Assistant after the effective date of any changes constitutes your acceptance of the updated Policy. If you do not agree with the changes, you may discontinue use before they take effect.

This Policy shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.
